BharatPe had moved the HC alleging that Grover had disclosed confidential information of the company on social media and had violated the employment agreement signed in 2021.
While Grover sought arbitration at the Singapore International Arbitration Centre, where a dispute regarding shareholders agreement was already going on, BharatPe opposed SIAC arbitration on the grounds that the employment agreement specified arbitration at the Delhi International Arbitration Centre (DIAC).
Justice C Hari Shankar appointed a sole arbitrator to resolve the issue, agreeing with BharatPe’s stand that the arbitration will proceed under the rules of DIAC.
In November 2023, the HC had fined Grover Rs two lakh for violating its May 2023 order that asked both the sides “to avoid recourse to unparliamentary and defamatory publications against each other.” Grover had then deleted the posts and apologised to the court.
